Ordering and Delivery

1. Orders may be placed via our website. Payment is not immediately required but must be completed before service activation.

2. Customers may cancel subscriptions at any time. Unless otherwise stated, services are non-binding.

3. Delivery times indicated on our website are estimates. Delays may occur due to stock shortages or technical circumstances.

4. If a server is out of stock, Latency Host will deliver within 8 calendar days. If delivery is not possible within this period, a full refund will be issued.

5. Custom orders (including specialised setups or configurations) are non-refundable due to setup costs.

6. Latency Host will make commercially reasonable efforts to maintain sufficient stock at all times.

Compute Services (Game Servers, VPS, and Dedicated Servers)

2.1 Acceptable Use

1. You must not use Compute Services for any unlawful purpose, including but not limited to: DDoS/DoS attacks, child sexual abuse material, copyright infringement, fraud, or any illegal activity.

2. Sending spam or unsolicited bulk messages is strictly prohibited.

3. Use of services as anonymising relays, open proxies, or tunnelling traffic to external networks without written consent is prohibited.

4. Cryptocurrency mining is not permitted on any service.

2.2 Security, Content, and Compliance

1. You are solely responsible for all content, data, and software hosted on your services and must comply with all applicable laws.

2. Latency Host may remove content or suspend services if activity is illegal, harmful, or violates these Terms.

3. You must secure your accounts and systems (passwords, SSH keys, firewalls, etc.).

2.3 Data and Backups

1. Latency Host is not liable for data loss. You are responsible for your own backups.

2. Backups via our Control Panel (if available) are retained for up to 2 months, then deleted automatically.

3. When a service expires or is terminated, data may be permanently deleted after 3 days.

2.4 Resource Usage and Performance

1. VPS: CPU and I/O are subject to fair use. Sustained high use that affects others may be throttled.

2. Game Servers: Performance may vary by plan and third-party code. We do not guarantee support for mods or scripts.

3. Dedicated Servers: While resources are dedicated, network capacity is subject to fair use.

4. We may take action to protect platform stability (e.g., rate-limiting or null-routing attack traffic).

2.5 Network and Abuse Mitigation

1. We may filter or rate-limit traffic during attacks or abuse events.

2. Recurrent or severe abuse may result in suspension or termination.

2.6 Service Lifecycle

1. Services not renewed by due date may be suspended immediately.

2. If unpaid after suspension, data may be deleted after 3 days.

3. Out-of-stock products will be delivered within 8 days or refunded fully.

2.7 Suspension and Termination

1. We may suspend or terminate for illegal activity, breaches, non-payment, or risks to stability.

2. Refunds are not issued for terminations due to your breach.

2.8 Software and Third-Party Support

1. We provide infrastructure support only.

2. Third-party software support is not included.

Support

1. Support is available via Discord or email at [email protected].

2. Standard response time: within 24 hours.

3. Support covers Latency Host services only.

Refunds and Right of Withdrawal

1. Refunds are issued only under this policy.

2. Downtime due to customer error or misconfiguration is not refundable.

3. Report technical issues via official support before requesting a refund.

4. Refunds will not be issued for lack of technical knowledge.

5. Approved refunds are processed within 7 business days.

6. EU customers waive the 14-day withdrawal right upon service activation.

7. Refunds must be requested directly; PayPal disputes or chargebacks are not allowed.

8. Chargebacks may result in immediate suspension or deletion.

Customer Responsibilities

1. You are responsible for the content hosted on our services.

2. Illegal content will be removed upon discovery or legal request.

3. You must comply with all applicable laws.

Force Majeure

Latency Host is not liable for delays or failures caused by events beyond our control (natural disasters, war, strikes, network outages, or cyberattacks).

Credits & Donations

1. Latency Host offers a donation system for contributing to server costs.

2. Each €1 donation grants 110 credits (€1.10 value).

3. Self-donations are prohibited.

4. Credits are usable only on the Latency Host website.

5. Credits are non-refundable and hold no cash value.

Data Protection (GDPR Compliance)

1. We collect data necessary for service delivery (name, email, IP, billing, etc.).

2. Legal basis: Article 6 GDPR (contract, legal obligations, legitimate interests).

3. Data is used for billing, security, and support only.

4. We may share data with processors or authorities when necessary, never sold.

5. Data is retained only as long as necessary; backups deleted after retention period.

6. You may access, correct, erase, or restrict your data by contacting [email protected].

7. EU customers may lodge complaints with their national Data Protection Authority.

Changes to Terms

1. Latency Host may update these Terms at any time.

2. Updates will be announced via our Discord or website.

3. Continued use of our services after changes means acceptance.
